Rental and Replacement Trucks: Planning ELD Records

Factor ELD explains the record-planning decisions that come with a rental or replacement truck. Confirm the actual rental period and applicable requirements before choosing the recordkeeping method, then verify the driver’s access to earlier records.

Factor ELD

A replacement truck is not automatically exempt

Start with the actual operation and the rental agreement. A company-owned spare, a long-term rental and a qualifying short-term rental may lead to different decisions. The word “replacement” does not, by itself, establish an ELD exception.

FMCSA’s TRALA exemption renewal addresses property-carrying CMVs rented for eight days or fewer, subject to its conditions. The published renewal runs from October 12, 2022 through October 12, 2027 unless renewed or rescinded. Check the current notice and every condition before relying on it; the ordinary HOS limits and required records still apply.

Work through the decision in order

DecisionInformation to establish
Is this a rental?Agreement, parties, vehicle and exact rental dates
Does a current exemption apply?Applicable operation, rental duration and every condition of the notice
What records are required?ELD or permitted alternative, plus earlier driver records
If an ELD is needed, does the setup fit?Engine, connector, device, mobile app and authorized account
What happens at return?End of assignment, retained records and authorized device/account handoff

The renewal notice requires the exemption document, the rental agreement and the required current/prior records to be available under its terms. It also contains accident-reporting and other conditions. Read the complete notice; this worksheet is not an exhaustive substitute.

Plan changes to the rental period

If the agreement is extended, have the carrier reassess the recordkeeping method before assuming the original decision still applies. The notice prohibits using repeated eight-day vehicle swaps or renewals to evade ELD requirements. Do not plan an operation around rolling short agreements to hide a longer rental.

Where an ELD is required, ask the rental company and provider who is responsible for equipment installation, accounts and returning the vehicle. Verify earlier-record access before the next assignment; using another truck or supplier does not erase the driver’s preceding work. Do I Need an ELD? A Fleet Applicability Guide. Rental-truck questions

Does every rental shorter than a week remove all logging duties?

No. A relevant exemption must apply and its conditions must be met. HOS obligations and required records remain; evaluate the actual agreement and operation.

Can the fleet move its ELD into the spare without checking anything?

Confirm permission, vehicle and cable fit, account assignment and the provider’s installation procedure. Complete the connection and record-access checks for the replacement truck.
