The 34-Hour Restart and ELD Records

Factor ELD explains how to review a proposed 34-hour restart in the driver’s ELD record. Confirm the applicable property-carrier rules, the uninterrupted qualifying period and the other limits that matter before the next drive.

Confirm the rule before counting hours

For property-carrying operations subject to 49 CFR 395.3(c), a qualifying off-duty period of at least 34 consecutive hours can end the applicable 7- or 8-day period. This guide does not apply that provision automatically to passenger, Canadian or other differently regulated operations.

A restart is an optional planning mechanism under this framework, not a requirement to stop every weekend. The record must support the actual qualifying period. A dashboard label does not replace that evidence.

Read this elapsed-time example

Assume the driver is subject to the federal property-carrier rule, uses Central time and has a continuous qualifying off-duty interval. This fictional example uses September 28–30, 2026, away from a daylight-saving transition.

Point on the timelineElapsed time since the start
Monday, September 28, 6:00 p.m.Start of the qualifying interval
Tuesday, September 29, 6:00 p.m.24 hours
Wednesday, September 30, 4:00 a.m.34 hours

Wednesday at 3:59 a.m. is one minute short of 34 hours in this example. The calculation establishes elapsed time only. It does not determine fitness to drive, resolve other record problems or approve a particular load.

Review interruptions and the next assignment

  • Identify the actual beginning of the qualifying period.
  • Review any work, driving or other event within the interval; do not conceal an interruption to make the total fit.
  • Use the carrier’s time reference and the real date, including any applicable clock change.
  • Confirm the next assignment against the remaining applicable driving, duty-window and break requirements.

If the driver performed work during the proposed interval, have the carrier review the facts and establish a valid qualifying period. Do not change an event simply to obtain a restart indication. HOS with ELD: A Daily Planning Guide. A Driver's Daily ELD Workflow.

Restart questions

Must a driver take a restart every week?

Not under this provision. The carrier must keep the driver within the applicable cycle limits, whether using a qualifying restart or managing the rolling period.

Does finishing 34 hours approve any planned trip?

No. Review the rest of the applicable limits, the driver’s record and fitness for duty, and the actual assignment before dispatch.
