A proposed change still needs the driver’s response
49 CFR 395.30 requires the driver to confirm or reject carrier-proposed changes. Appropriate edits, recertification and resubmission are needed for those changes to take effect. A carrier may not request edits before the driver has submitted the records.
The goal is an accurate record. A proposed correction is not a way to erase a violation, move driving to a more convenient day or certify events the driver has not reviewed. The original information must be preserved, and changes or additions require annotations.
Review one change at a time
| Review field | Question to resolve |
|---|---|
| Original event | Which driver, date, vehicle, time and status are involved? |
| Proposed event | Exactly what information would change? |
| Reason and evidence | What actually happened, and what supports the correction? |
| Driver decision | Does the proposal make the record accurate within permitted edit limits? |
| Completion | Are the annotation, driver response and required recertification recorded? |
Suppose a driver notices that a non-driving event describes the wrong activity. Compare the event with the actual task before responding to a proposal. If the proposed correction is also wrong, reject it and provide the factual issue to the carrier’s reviewer instead of accepting it merely to clear a notification.
Keep a disputed item visible to the reviewer
Record the disputed event and explain what needs investigation. Do not delete the app, create another account or remove the underlying record. Ask the responsible fleet person to use the documented review process and preserve the history.
Button names and notification screens can differ between products and versions. In a Factor ELD demonstration, ask to see both the carrier proposal and the driver response in the exact configuration being offered. A Driver's Daily ELD Workflow. Unassigned Driving Time: Review and Resolution.
Edit-review questions
Can an administrator certify the driver’s day on the driver’s behalf?
The certification is the driver’s responsibility. An administrator’s proposed edit does not replace the driver’s required review, response and certification.
What if an edit is needed after the day was certified?
Use the supported correction process, preserve the original information and recertify after the edit as required. An already certified day is not a reason to leave a known inaccuracy unresolved.
